DEEDS & RESTRICTIONS

Lake Ridge Estates - Covenants and Restrictions


Lake Ridge Estates is committed to the quality and upkeep of the development. It is our duty as land owners to be stewards of this beautiful property to not only preserve this land for generations to come but to also preserve and grow the value of the land

to those who have invested in it. These restrictions will be enforced by the developer K&G Hilltop Properties, LLC until the development is 80% sold at which time these covenants will be turned over to the landowners to edit and enforce by a simple majority vote.


LAND USE


  • No Lot shall be subdivided.
  • Each Lot shall be used only for single-family residential purposes or for overnight
  • rental.
  • In order to create a “fire barrier”, all trees/brush within 30 feet of Dwelling may be
  • removed.
  • Any trees obstructing the home site or obstructing natural sunlight needed for solar
  • energy may be removed.
  • Aside from exceptions noted above, no more than 20 percent of trees shall be removed
  • that are more than 6 inches in diameter and 6 feet from ground.
  • The remainder of the trees shall be maintained. Should a tree naturally fall it should
  • be taken care of in a reasonable amount of time to upkeep the beauty of Lake Ridge
  • Estates.
  • Clear cutting of underbrush is not allowed outside of a 100’ perimeter around the
  • main Dwelling. We want to keep Lake Ridge Estates looking natural.


ARCHITECTURAL/BUILDING GUIDELINES


  • No Structures shall be erected, altered, placed or permitted to remain on any Lot other than one detached single-family dwelling, one private garage (maximum of 1,000 sq ft), one tree-house (maximum 400 sq ft), and other outbuildings incidental to residential use of the building site.
  • No residence shall be constructed upon the designated residential tract unless said residence contains a minimum of sixteen hundred (1,600) square feet of living space.
  • “Living space” is defined as that square footage under HVAC, exclusive of any garage, porches, patios, and decks under a common roof.
  • All Structures shall be of conformity and harmony of external design with existing
  • Structures in the Development and as to the location of the Building with respect to topography and finished grade elevation in the Development.
  • Roof pitch and colors are to be consistent within the Development.
  • Barndominiums are prohibited.
  • All structures shall be sightly, of neat construction, and of character to enhance the value of the Property.
  • All Dwellings and other Buildings incidental to the use of the Lot for residential purposes shall be erected on the Lot and shall be underpinned. Except as provided herein, no mobile homes, modular homes, prefabricated homes, residential trailers, tent or structures of any type or character shall be moved onto, placed on or allowed to remain on any Lot. A motor home or camping trailer may be placed on a Lot by the
  • Owner of the Lot for a period not to exceed 180 days, for use during clearing and construction on the Lot.
  • Should the owner choose to have a recreational outdoor fire pit, it must be in harmony with other building sites and should be made out of such materials that are fire safe and not endanger the natural environment. The intent is the fire pit or outdoor fireplace would be of stone, rock, and cement lined with fire brick. Other necessary building precautions would be recommended.
  • All wood-weathered building material or firewood should be kept neatly and preferably stored in the proper outbuilding, at least 30 feet from any Dwelling or Structure.
  • Residential structures must be approved by K&G Hilltop Properties prior to building.


LOCATION OF BUILDINGS AND IMPROVEMENTS


  • Primary residential buildings should not sit within 50 feet or less of the lot line on any side. Exception: A Primary residential building may sit up to 5 feet from any lot line shared with the National Forest or US Core of Engineers.
  • All propane tanks must be installed underground.
  • All septic tanks must be installed underground.
  • Easements for drainage facilities are herein reserved and within these easements, no structure, planting, or other material shall be placed or permitted to remain which may cause the direction of flow of drainage channels in the easements, or which may obstruct or retard the flow of water through drainage channels in the easements. The easement area of each lot and all improvements in it shall be maintained continuously by the owner of the tract.


BUILDING MATERIALS


  • All exterior walls of all Dwellings and other Buildings shall be of native and authentic building materials such as rock, stone, or wood, which shall cover no less than 80 percent (excluding glass, windows and doors) on the exterior.
  • No more than 20 percent of non-native materials shall be used on the exterior walls such as masonry/brick, processed wood, metal, etc. Stucco and vinyl are prohibited on exterior walls. Pre-cast concrete panels are allowed at no more than 20 percent of exterior walls (texture, pattern, and color subject to approval by developer).
  • Buildings incidental to the use of the Lot for residential purposes shall be constructed of materials similar in design and color to the Dwelling.
  • No metal Building shall be erected, placed, or allowed to remain on any Lot.
  • Max structure height is 35’.


DRIVEWAYS


  • Driveways for personal use must originate from a point of the original dedicated/platted roads of said development and shall terminate at a point not outside of owner’s original lot. It is the intent of this covenant to prohibit ingress and egress from any other area. Exception: If written easements are signed and filed by all owners of any lot or partial lot that said easements are intended for, then these easements are valid.


DEVELOPMENT ROAD MAINTENANCE


  • Each Lot owner shall maintain the development road adjacent to their Lot at their own expense.


PROHIBITED USES


  • No motor vehicle shall be parked on a Lot unless the motor vehicle is on inflated tires and is mechanically operational.
  • All vehicles on the property should be working, non-working vehicles will not be stored or abandoned on the property.
  • No Lot shall be used for outside storage. No materials or supplies shall be kept or allowed to remain on a Lot unless stored in a Building. Provided, however, materials or supplies for use in a Building or Structure may be kept on a Lot for a period not to exceed ninety (90) days during construction.
  • No salvage, junk, or unsightly accumulation of materials shall be placed or allowed to remain on any Lot.
  • No Lot shall be used or maintained as a dumping ground for rubbish. Trash, garbage or other waste shall be kept in sanitary containers at the rear of the Dwelling out of sight from Roadway, and placed roadside on the day of garbage pickup.
  • No Building on any Lot, other than the Dwelling, shall be used as a residence.


PROHIBITED ACTIVITIES


  • No business or commercial activity of any kind shall be conducted on or from any Lot other than overnight rental of Dwellings. Any exceptions to be approved by K&G Hilltop Properties, LLC.
  • Exterior construction work and land clearing is prohibited on Saturdays and Sundays within 1,000 feet of a Dwelling that is inhabited or rented.
  • Discharging a firearm is prohibited. Hunting or shooting of wildlife is prohibited.
  • No animals, livestock, or poultry of any kind shall be raised, bred, or kept on any Lot except that dogs, cats or other household pets may be kept, provided they are not kept, bred or maintained for any commercial purposes, and further provided that said animals do not become nuisances to the surrounding property owners.
  • No noxious or offensive activity shall be conducted upon any Lot, nor shall anything be done thereon which is or becomes an annoyance or nuisance to the neighborhood, including but not limited to, making any unreasonably loud or disturbing noise which substantially impairs the enjoyment of surrounding Owners, their renters, guests, or invitees.
  • The operation of ATVs, dirt bikes, and all others motorized off-road vehicles, shall have limited authority to use Development Roadways only for egress to and from the National Forest, or to and from other Dwellings in the Development. All such vehicles must be equipped with factory noise suppressors and factory spark arresters, be driven safely at speeds under ten (10) miles per hour at all times while in the Development.


PROHIBITED STRUCTURES


  • No fence shall be placed or permitted to remain on any lot. Only exception would be anti-privacy fencing (fence that you can see through) for pets attached to main Dwelling. Anti-privacy fenced area not to exceed 1 acre. Anti-privacy fencing prohibited on property lines. Anti-privacy fencing cannot obstruct views and may not be over 5’ in height.
  • No sign of any kind shall be displayed to the public view on any Lot except one professional sign of not more than two square feet in area and one sign of not more than four square feet in area advertising the property for sale, and signs used by a building contractor during construction.
  • No above-ground pools, or properly maintained hot tubs are permitted with outer casing in harmony with other external buildings.


CONSOLIDATION OF LOTS


  • Any number of adjacent Lots can be consolidated into one Lot and recorded in the Office of the County Clerk, McCurtain County, Oklahoma. If two or more Lots, or portions of two or more Lots are consolidated into a single building site then the setback requirements for Buildings shall apply to the resulting site as if it were one original, platted Lot.
